The Way Home – Parental Consent Terms

These Parental Consent Terms ("Terms") apply when a parent or legal guardian invites a minor ("Child") to join their household group within the The Way Home mobile application ("App").

The App is owned and operated by Lyfebynary 0103 LLP ("The Way Home", "we", "our", or "us").

By proceeding to invite and register a Child on the App, you ("Parent" or "Guardian") confirm that you have read, understood, and agree to the following Terms.

1. Eligibility and Authority

1.1 You confirm that you are the parent or lawful guardian of the Child whom you are inviting to the The Way Home App.

1.2 You confirm that you have the legal authority to provide consent on behalf of the Child for the collection and processing of the Child's personal data.

1.3 You confirm that the Child is below the age of eighteen (18) years, as defined under the Digital Personal Data Protection Act, 2023.

1.4 You agree that The Way Home is entitled to rely on your declaration of parental authority and is not obligated to independently verify guardianship beyond reasonable verification procedures implemented by the App.

3. Parent Responsibility for Child's Use of the App

3.1 You acknowledge that you are solely responsible for supervising the Child's use of the App.

3.2 You agree to:

  • Monitor the Child's use of the App
  • Guide the Child regarding appropriate use of digital services
  • Ensure that the Child does not misuse the App or its features

3.3 The Way Home does not actively monitor communications or interactions between family members within the household group.

3.4 Any information shared within a household group is under the control of the Parent and family members, and The Way Home is not responsible for how such information is used or interpreted by the Child.

4. No Targeted Advertising or Harmful Processing

4.1 The Way Home does not knowingly engage in:

  • Behavioural tracking of children
  • Targeted advertising directed at children
  • Processing of children's data that may cause harm to the child

4.2 Processing of the Child's data is limited strictly to providing household management and collaboration services.

5. Parent Control Over Child Account

5.1 As the Parent or Guardian, you retain full control over the Child's participation in the App.

5.2 You may at any time:

  • Remove the Child from the family account
  • Delete the Child's profile
  • Request deletion of the Child's personal data
  • Modify permissions granted to the Child within the household group

5.3 Requests for deletion or modification of the Child's data can be made via the App or by contacting The Way Home at info@thewayhome.app.

6. Parent Liability and Accountability

6.1 By inviting a Child to the App, you acknowledge and agree that:

The Child's use of the App occurs under your supervision and responsibility.

6.2 To the maximum extent permitted by applicable law, you agree that you shall be solely responsible for any consequences arising from the Child's use of the App, including but not limited to:

  • Actions performed by the Child within the App
  • Content or information shared by the Child
  • Misuse of the App by the Child
  • Any disputes arising between family members related to App usage

6.3 The Way Home shall not be liable for any damages, claims, losses, disputes, or consequences arising out of or related to the Child's use of the App.

7. Indemnification

7.1 You agree to indemnify, defend, and hold harmless The Way Home, its founders, directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

  • The Child's use or misuse of the App
  • Any violation of these Terms by the Parent or Child
  • Any claim made by a third party arising out of the Child's activities within the App
  • Any inaccurate or false representation regarding parental authority or consent

7.2 This indemnity shall survive termination or deletion of the Child's account.

8. Data Security

8.1 The Way Home implements reasonable technical and organizational safeguards to protect personal data processed through the App.

8.2 However, the Parent acknowledges that no digital system can guarantee absolute security, and The Way Home shall not be responsible for risks inherent to internet-based services.

9. Withdrawal of Consent

9.1 You may withdraw parental consent at any time by:

  • Removing the Child from the household account
  • Requesting deletion of the Child's data

9.2 Upon withdrawal of consent, The Way Home will stop processing the Child's personal data, except where retention is required under applicable law.

10. Updates to These Terms

10.1 The Way Home may update these Terms from time to time to reflect:

  • Changes in applicable law
  • Updates to App functionality
  • Improvements in privacy practices

10.2 Continued use of the App after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023 and any applicable rules issued thereunder.

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.

12. Parent Confirmation

By clicking "I Agree and Send Invitation", you confirm that:

  • You are the lawful parent or guardian of the Child.
  • You provide verifiable consent for processing the Child's personal data.
  • You accept responsibility for supervising the Child's use of the App.
  • You agree to the liability and indemnification provisions stated in these Terms.
